one can make the argument that since Hamilton was not completely clear of Webber, it is the responsibility of Hamilton to stay outside until the pass is completed. It didn't look like Webber ran Hamilton to the wall - he stayed right on the inside apex. Hamilton turned in assuming that Webber would give up the position.
