To answer the OP's question, the father needs to file for separation and custody. Shouldn't be hard to do. But the boy will be in Social Services custody just as soon as the cops or social workers hear about this. Or, if he tries to attend school they will pull him out and place him with a foster family if they can. Otherwise, he will spend his time in a detention center until the paperwork is worked out. There is no need for charges to be filed. That's automatic.
The father needs to move fast and be in the lawyer's office tomorrow morning.
