yep. for fear that those that cannot afford would not bring things to trial. however, i am not proposing that the party pay for the costs, but the lawyer. plus, the judge could rule that there was some merit, perhaps a lot of merit, in the lawsuit, and only bill the plaintiff lawyer a small percentage.

edit: i also think that the jury, if such is the case, should be allowed to punish the judge for hearing a lawsuit, with no merit, up to and including a fine of 110% the court costs for wasting their time and our taxpayer money.
