I posted that here a few weeks ago. Deceased was a former sheriff's deputy and certainly knew he was starting an unjustified gunfight. He was well known for his anger mgt. issues. Shooter, a combat vet, recently returned from the sandbox, was still on full alert. Having a gun saved his life that day.
My problem is that the DA said he's not filing charges because he probably couldn't get a conviction. Even if he could get a conviction, this was a very clear cut case of self defense and no charges should be filed. Self defense shootings are legally justified in plenty of other places where a jury would convict, however. Hopefully, our law exempting him from civil liability too, in the case of a justified shooting, will keep him from financial ruin.
