It appears (according to my short internet search) that 9 out of the 10 indicted for the scam went to jail with terms ranging from 13 months to 6 years. Pesto was the only one mentioned in the case who was not mentioned in the articles about the August 09 sentencing.
A search of the BOP inmate locator comes up with this:

So, it seems he is out, cannot make his living scamming penny stocks for awhile and is likely looking for a new way to steal. $200,000 rare auto scams might be his new thing.
