Every vehicle bought and sold in California has to legally comply with emmisions standards.
If it's old enough you don't have to have it tested but legally you still have to comply.
I'm betting that BJ's lawyers got all california'd up and said that is a vehicle doesn't have current registration and smog cetificate it doesn't comply with emmissions just to cover their butts to keep from getting sued.
