Left to its own devices, I can think of no private sector entity that wouldn't immediately terminate that pilot, deservedly.

Youre still missing the point. If they had a union, he would have cancelled the flight and not have to worry about getting fired. Since they don't, he feared termination if he didnt complete the flight.
