I don't know if this helps, but I waited until the last minute and got an extension to file the TBWD. Mostly because I procrastinate. Once you hand in your declaration, then the court sends a notice to the cop, who then has the chance to respond. By delaying things, I've wondered if it helped make the cop forget (despite what ever notes he had) details.
If you do go this route, do yourself a favor and write down the details of what happened ASAP, so you don't forget.

This can work against you, the court will trust the cops notes vs your memory if you wait a long time. Had a friend on jury duty that the defendant delayed court for years, at that point, the defendant could be suffering from very selective memory, and the cop has his notes. Guess who won that one?
