I evaluated a guy once who was one of those pick-me-up-at-Home-Depot day workers. He did some tree trimming for a guy, but accidentally lost control of the chainsaw while 40 feet up in the air and nearly cut his own arm off. Fire dept had to be called in to rescue him, as he couldn't climb down by himself. FUBAR'd his forearm, for sure. They fixed him up as best as they could at County, and he was in the process of suing the property owner who hired him.
What I thought were ridiculous were the reasons for the lawsuit: property owner did not provide for adequate training or safety measures, safe chainsaw was not provided by property owner, etc. I mean heck, if I'm hiring you off a street corner to do landscaping/tree trimming and purposefully looking for someone who's going to do it under the table, what kind of professional supervision do you think I (as the property owner) am going to be able to provide for you? I certainly have no knowledge (or likely equipment) to do the job--that's why I'm hiring you to do it.
