States are prohibited from regulating internet service providers because the Federal Communications Commission (FCC) classifies them as information services, not telecommunication services. The states only have authority to regulate telecommunication providers. As a federal matter, this is something that your congressmen may be able to address.

On a related note, I was informed by the state Public Utility Commission that regulation of VoIP service (not internet service) has been considered by many states. The issue is murky because there are four types of VoIP service and the FCC has preempted one of those types of VoIP service. The FCC has been silent on the other three types. If the FCC explicitly delegates authority to the states, it would be clear. If the state passed a law regulating the three remaining types of VoIP service, there would be legal challenges.
