More often than not, you get penalized for what you do, not the intent. Examples would include making accidental contact with a ball, as on a green. Or, accidently grounding a club in a sand trap. Etc....

We can argue this all day. None of us are participants in the event and none of us have any direct knowledge of what took place. Tiger will get convicted in the court of public opinion, regardless of what he did. Doesn't matter to me, as I am not Tiger.
