You get witnesses saying he hit you and you didn't back into him? If the guy who hit you states that you backed up, they won't pay.
You can get the car fixed pretty quickly, and then trade it. I don't think it'll show on carfax THAT quickly.....Either way, it's gonna happen so go fast.
