Do you have PIP coverage(personal injury protection)? If so, just open the claim and run your medical expenses, lost wages(sick/vacation leave), etc. Of course it is capped by your policy limits usually 5-10K. Use these bills, lost wages, etc. as your support for settlement plus your pain and suffering.
By law you're required to carry the liability but not the PIP. Looks like everyone above has pretty much covered the rest. You may want to do a search on OTF because I have seen several threads in the past year on the same subject matter.
I have been rear ended 4 times. Almost sounds like a bad prison movie...
