I've had this happen to me, some one just walk in front of me in the pits right at the edge of where I need to go through. The driver- from his view point, cleared the GUY. The guy had the tire sticking out farther - out of driver's view. You gotta remember, these cars have high sides - the driver can't see what is low and close AT ALL. If the pit crew member had of had the tire on his right, and been on the edge himself, the driver probably would of seen and missed him.

The driver cannot really be to blame in this, unless he had a clear racing car that he could see through in a full 360.
