Is he a licensed dealer in CA.? Because it is completely, 100% not allowed to keep any part of a deposit from a prospective buyer if he or she does not wind up buying the car. Even if he is not a licensed dealer, the law is on your side.
Get ahold of some regulatory agencies, (google search to find which ones), and go after this slime. And FWIW, that is one 3rd rate POS car. All of the good early 911s have left the room, a long time ago. If you do not already have one, pick a different object of desire. You could actually own a great Porsche for the $$ you were about to waste on that toilet.
