The law absolutely "sees it that way..."
You need actual evidence, (what a concept), that a person's race/nationality/sexual orientation/etc. was the prime motivation for an assault to file the additional charge of Hate Crime on an attack. This usually, but not always, comes in the form of some type of admission from the genius who did the crime.
The fact that a perpetrator and victim are of different ethnicities by itself doesn't mean squat, except to the chattering heads on cable news and the internet. I'm not going to watch the disgusting video now that I know what's in it.
