That was part of a email I wrote today, instructing my union to have a lawyer battle with my employer over withholding agreed employee entitlements.
The first step is to lodge a dispute with the governing body that certifies employment contracts (in this case the employment contract is called a Certified Agreement and is fundamentally an enterprise agreement negotiated every three years between all employees and the employer at a specific place of work. An employer may have many such agreements in place across it's business, but each agreement is workplace specific and only pertains to employees at that site) and see if it can be sorted.
But if they still want to fight and are found to be noncompliant with the legislation (the Act), then the section of the Act that they are noncompliant with is also a civil remedy provision (fines are issued).
