Location: Placerville, CA.... You know, the only place on Highway 50 between Sacramento and Lake Tahoe the you find signal lights. Above the fog most of the time and I can see the stars of the Milky Way 8 out of 10 nights. Kinda cool.....

Let's paint a picture of the whole screen before we pass judgment:

Embedded UC/LEO in a hostile crowd to monitor and report activities due to previous reports of property damage and injuries to the public caused by riotous crowds. He and his assigned partner encounter a subject they need to take action with. They start to deal with the party and a hostile crowd of 100-150 parties start to confront the officers.

The LEO is standing with his l/hand on his partners back who is laying on top of the subject. So not only is he watching out for his safety, his partner's safety as well as the subjects is at risk from the hostile crowd. And yes, the main body of the crowd is not in view of the photo. Being outnumbered 100 to 1 or 2 is a bad spot to be in.

The photo was taken in 1/1000th of a second in a situation that lasted much longer than that. In the process of drawing his service weapon, it appears to be in that particular angle. Besides, in that situation, does it really matter? Holding a subject down while holding a hostile crowd back is a lot to do at once. Most people have a difficult time driving and listening to the radio, let alone deal with a potential life and death situation. Until you yourself(general reference intent) are faced with that type of situation, just keep in mind there is much more to the situation that what a single photo can depict.
