Where have I been rude? Where is the rant? Sorry I am just explaining REAL facts not the nonsense that some have posted. People think they have an idea of how Ins works and post information on the net that has zero merit. You should be taking my information as help but if you want to hear about my cousins friends sister who once had an auto claim well I guess listen to the others.

So is GA is a no fault state correct? Yes, it applies to property damages and is why they offered you a percentage.

Lets fill in the facts

1st party or 3rd party claim? (why would they offer their insured a percentage???)

Did they offer you a percentage based on fault and if so what was the percentage?

What was the ACV (actual cash value) before any deductions?

What were the deductions for miles, condition and missing parts?

Do you have a copy of the evaluation?

If it is 3rd party what is the deducted salvage value?


If your car is in average condition they are entitled to deduct for miles no matter what condition the engine is in. It is based on the assumption that your engine is maintained and in good working order so your dyno is not proving additional value. Like it or not people pay less for higher miles cars. If your car did not have parts on it at the time of inspection the insurance co writes a PRIOR damages estimate and deducts that amount from the value of your vehicle. Again you would pay less for a car with missing parts. If they aren't on the car that is not their fault. Remember those parts are a lot more expensive then you think as they have to write OEM or from a reputable salvage yard not parts listed on Pelican. Those missing parts can add up to thousands very quickly.

The evaluations are run by independent 3rd parties so again the ins adjuster is just reading the numbers. I would check the evaluation to verify all the information is correct especially with an older vehicle as options get dropped with age.

What I am trying to do here is show you that the $19,500 might be more reasonable when you add $2500 in prior damages, $1500 for milage, and then add the percentage for your fault in the loss and you would see the initial ACV might have started at $25k or so.

Get the eval and find out what the real numbers are. Again read my posts I have clearly said I hope you get all that is entitled to you. Read my posts where I have asked you questions to assist you. Read my posts where I have given you facts not nonsense. Yes, that was a rant.

Good luck and I guess you are more interested in the F the Ins Co answer instead of something that can help you.
