Actually building a third locker room was addressed in a complaint against a school that designated a bathroom for gender unclassified persons. The persons felt that making them use a bathroom designed/designated just for them was discriminatory and they wanted to use whatever bathroom they wanted.
I bet the company didn't give her a full refund.
