When an item gets lost in the mail, who is responsible ?

Let me start out by saying, that my local post office is not on like donkey kong. My mail goes missing quiet frequently now . Anyhow, recently, I bought some 914 stuff via e bay. I see that they shipped, and I tracked the package to my local post office, but it never arrived .
I had started a claim with e bay , and I was surprised to see that they awarded my monies back. It was small potatoes, but still.
I had messaged the seller, and they told me to take it up with the local post office, which we all know is a dead end road, and I simply don't have time to chase 25 dollars worth of parts. I bought another set from the original seller, and they came right on time .
I did not think it was fair that e bay sided with them, and refunded my monies , but, on the other side of the coin, I paid my monies, and never received my parts, not really my fault either .
Like I said, it was small potatoes, so no insurance. When I ship anything of any value, I always insure it .
