Internet Speed issue

At my house yesterday, I swapped out my 4 x 4 DOCSIS 3.0 modem for a 28 x 8. When I tested with my PC direct to cable modem, I was able to get 127Mbps down with 12Mbps up. When I put the router into place, the speed drops to 40Mbp, with still 12Mbps up. Tests were do hardwire LAN to one of the 4 ports.

My router is a NETGEAR FVS336Gv2. It is dual WAN, but I'm only using one port.

Specs
LAN to WAN throughput is 350MBps - guessing this is with both WAN ports

It is dual IP4 and IP6, but the IP6 is not active. I have an active gateway to gateway VPN.

Any thoughts?

My work is rated at 50/10 but I'm getting similar results to the house with the exact same equipment. So I do believe it is the router...
