As far as I know regarding NY titles you have an issue on your hands. If he never filed the paperwork to execute the lien then he is not legally the owner of the car and cannot legally transfer ownership to you. He would have to obtain a proper title to the car and then transfer that title to you. Good luck at the DMV ask 4 different people there and get 4 different answers. As stated above hire someone who works with titles and let them handle it. Ask your insurance agent if you have one they should be able to help you.
