I disagree. Anyone who breaks into a home in the middle of the night has to assume the home is occupied and that the homeowner is ready for a fight. I highly doubt anyone breaks into a house (at least late at night) and then acts surprised when confronted by the homeowner. If your house is broken into while you're home, you should assume you are fighting for your life and act accordingly. And make sure the cops can only hear
your side of the story.
