Agreed, but I think that is the exact point. The average cons-mooo-mer does not have the time, energy or talent in many cases to even understand what exactly they are consenting to when they click "I Accept" on conditions for a site, any more than those same folks are not able to guess what is in food or chemical products without a regulatory require label and in language the average person has at least a chance of comprehending.
I think this needs go to a positive assent model on either a fairly regular or even case by case basis where you have to opt in to have any of your information used.
I think it also has to have positive affirmation of ID as well, personally the anonymity that the internet offers is both a gift and a great evil...
I have always said to the IT organizations I have run when it comes to policies, if my mom can't understand it, and she is 90 years old and English is not her first language, then it is too complex....do it over.
It needs to be simple, even to an old US senator...
