Same dealer? Back in '65 I'd ordered a car from a dealership...while waiting for the order, they got a car in stock that I thought I'd like better. Not a problem making the switch. But then, the one I liked better had a higher sticker, so that was probably a factor.

Denis, interesting thing about 3-day cooling off periods and in-home sales for contracting, etc. in CA. If the customer signs the contract in the office, there is no grace period. If the contract is signed at the customer's residence, or any other venue say like the customer's office or a home show, the 3-day period is valid.

If you want to see how 'set in stone' the deal is, ask if you get the same trade in price after the accident you had Sunday...
They can't hold you to it if you didn't take possession and they don't have your trade. If you had left with the new car they could have claimed your trade in is gone...

Even if they were to sue you, they would have to establish damages. On this case maybe an hour of an admin’s time. $25?

Guys, this is not an adversarial thing. The salesguy emailed me back today, reminding me that the 430i was the first car I sat in and that I had decided against it due to less backseat space and that the 320i was more in line with my work and lifestyle (driving a ton for work and hauling band gear). I really think he was on the ball and listening to me. However, I will take a look at the 430i on Wed. when I go to swap cars. If it really grabs me, and I will know the feeling if it does, that's when I'll put my foot down.

I think you need to find out if you're obligated to take the 320i, which I seriously doubt you are. Assuming you're not, you have the leverage to make sure they give you a fair deal on the 430i and if they don't, you can walk away from both. You need to know you that you don't have to get hammered if you switch to the 430i. They would rather sell you one car than none. Don't spend a minute worrying about the commission the salesman is making on one or the other, or making up the difference. If you walk away from both, toss him a couple of hundred dollars if you want for you clear conscience on wasting his time. Very few people do that, but it's a classy move.

The only thing between you and the 430i is money. Ask the dealer for a number, they are not going to walk away from a chance to take more of your money.

I guess it's going to come down to which car they have more margin on. This thread makes me pretty sure I can get my way on either car. They know they have me. Mrs. Lee has bought from them before and is shopping again. I don't think she'll come with me tomorrow though. My salesguy is headed on vacation tomorrow and I'm booked from 9am - 8pm today, so I just cannot deal with it until tomorrow. And that means I'll be dealing with other people when I get there.

If I were you, I'd have let the dealership know about this already. They are going to be more amenable to changing cars if they haven't already filled out the MSO in your name on the car you did buy.

I checked with a dealer I know in AZ, and he said they need delivery to complete the deal.
