Exhausting NY
New York has put a new law in effect severely restricting exhaust systems in the state.
My friends at Speedwerk NY are wondering how this will affect them and their customers. https://www.nysenate.gov/legislation/bills/2021/S784 " 31. Mufflers and exhaust systems. Prevention of noise. (A) Every motor vehicle, operated or driven upon the highways of the state, shall at all times be equipped with an adequate muffler and exhaust system in constant operation and properly maintained to prevent any excessive or unusual noise and no such muffler or exhaust system shall be equipped with a cut-out, bypass, or similar device. No person shall modify the muffler or exhaust system of a motor vehicle in a manner which will amplify or increase the noise emitted by the motor or exhaust system of such vehicle above that emitted by the muffler or exhaust system" |
“…to prevent any excessive or
unusual noise and no such muffler or exhaust…” Without quantifying “excessive or unusual” the law may be selectively applied to egregious violations? “Sound testing”, IIRC, is hard to define without a specific test criteria and calibrated equipment, operator training etc. |

Seems pretty vague, except for the specific disallowance of cutouts/bypasses. Noise level is up for interpretation then? It will depend on enforcement.
As for bypasses, I wonder what that means for factory servo activated sport sound packages like Porsche makes. (And after-market versions.) |
When the elected officials have all problems resolved, they’re able to look at the trite and resolve the major complaints.

Reads like it's going to be used to target twats. People that run their car up to the rev limiter and hold it there. People that rev at lights for no reason, Harleys, crotch rockets, etc....

What exactly is new about this? Pretty sure this has been the law here for many years as I’ve received 2 tickets nearly 20 years ago regarding both my motorcycles for reasons exactly as stated in what you posted, unless this is a county specific law. I didn’t look deep enough into the reg to understand if that’s the case or not
As for how it effects businesses, as far as I can see, it doesn’t effect them any more than tinting laws effect tinting companies. Customers buy and take the risk just as I have…..although I had a local Harley dealer refuse to pass my inspection with aftermarket exhaust installed. I said what the hell are you talking about, you sold them to me and installed them you a holes |
Sometimes complaining to your elected officials has an effect. Seems noise is one of the biggest issues from residents calling the Police and Government.
https://www.nysenate.gov/issues/noise-complaints The summer nights are deafening with loud exhaust 4 cylinder cars, and open pipe Harley's cruising at 2am. It will be selectively enforced of course. It can make it difficult for the yearly NYS Inspection stations. Fortunately for me, my 1972 2 stroke Kawasaki Widowmaker is exempt. |

This is all such horse shiet. Below is a casual extraction from the Ohio E-check regulations which is old as eff.
They have no staff to enforce. It's the honor system. For example, if an empty air pump bracket needs to be removed in order to work on a water pump, the missing air pump must be replaced. If incorrect headers or exhaust manifolds need to be removed in order to perform work on the transmission, the proper exhaust manifolds or headers need to be replaced in order to avoid performing illegal emissions work (this includes vehicles containing test pipes rather than catalytic converters). Simply replacing the tampered part as it was when the vehicle entered the shop would be a violation of the tampering prohibition. |
