The forensics guys will figure out that you shot the perp after he was down. I wouldn't want to sit on the stand in front of a jury and defend my "kill shot," especially if your jury is not exactly made up of your peers. You might get away with it but you might not. I would bet that a single shot (that drops the perp) is far more defendable in court than several shots plus one that could look suspicious. This isn't the hairy-pitted liberal position, it's likely how it would unfold in court. Once the law gets hold of you they won't let go, even if it takes years to nail you. Any LE or legal folks want to expand on this?

Dead men tell MANY tales. You have to get rid of the body a-la the Sopranos or else the forensics guys will eventually get you.

And I wouldn't do such a thing, no matter the circumstances of the shoot. You're under no obligation to explain yourself to the cops or the DA and certainly don't have to take the witness stand in the unlikely event you're charged with anything. You don't even have to call 911, though I wouldn't want to have to clean up the mess myself. The burden is on the state. When a dead guy is laying in your house late at night with signs of forced entry, unless you live in a police state, you're usually justified in fearing for your life, which means you're justified in using deadly force to stop the intruder from going any farther into the house.

You never pull any weapon unless you are A. are afraid for your life and B. ready to shoot to kill.

This is not a warning situation, if a gun is pulled, it should be because you are ready and need to use it or you will get in trouble for threatning someone.

David, Your're right... but.... if a gun is "fun" to shoot, you're more likely to take it to the range and become proficient with it! The Colt 1903 Hammerless is "fun" but it's also a very dependable, concealable gun that I trust to help me defend myself or loved ones if need be...
