gave landlord dude a call.

he came up with some rather liberal interpretation of the law... then i proceeded to make firewood of his arguments and the methods he used to get his rent increase...

At some points there was audible frustration on his end of the phone... and i explained to him that really, there's no rent increase, and if he wants a rent increase,
he'll have to work harder, and perhaps try and get it via de 'vrede rechter" ( our version of judge Judy) , but that chances of success are rather low since the vrederechter need to see a 20% value increase in the property, and that the common knowledge is they don't usually favour the landlords , especially not in these kinds of situations (house converted to appartments), sent some some more arguments for the stove....

Then he said, well, i'll do that, and you'll hear from me in a few months..
That's fine, i'm looking forward to it.

Sis is up for a social flat, so with some luck she'll be long gone by then.. I was just fighting it because A 30 euro's a month is a lot of money for her B out of principle because he used douchebag tactics on somebody who can't defend himself


He hung up, and 30 minutes later, calls me to let me know, he contacted his lawyer, and the rent is ok to stay as it was... but he'll get everything in ordere, to get the rent increase the right way..


His lawyer probably said something like " your are dumbass, off course you can't demand a rent increase like that.. what were you thinking, that'll be 100 euro's, i'll send you the bill"

Those 100 euros will work themselves into the future rent increase. Hopefully, your sis will be out of there before that comes to pass.

Jim, that's the whole point.. he cannot get rent increases legally. That's the point where i just set him straight on.
even more : in march he'll be forced to agree to a rent decrease due to deflation...i'll make sure his tenants get the standardized letter from me, when i'm busy moving my sister to the social flat. Along with information how they can undo the rent increase he tried with my sister just now... retroactively ...

The only way you can increase the rent in Belgium are

1 index jumps (inflation/deflation, set by the state index)

2 rent contracts are 369, so 9 years, with possibility to increase on the 3rd year, and the 6th year
But that increase has to be either agreed upon
or set by Judge Julie

The requirement is then, that he has to be able to proove a 20% increase in the value of the property (not including inflation, but actual improvements to the property)
He would have to invest a hellofalot more then he did just now to warrant such an increase

And the Judges generally do not favor the landlords in such cases. Especially not in cases where the property is a house , split up in appartments that really do not represent the top end of the market, with tenants typically not lower financial class..
That she works in a social workplace due to her mental disadvantage would only work against the landlord.

To put it in perspective, she payed 369 now
he wanted 420
she makes, on a good month, 950 or something, and on a bad month (factory not having work, often a week a month of commercial unemployement) she might get 850.
Then there's utilities, food, cloting, medical... and she's not what we would call rich
I managed to keep her debt free so far, 369 is doable, but 420 is pushing things over the edge for her..

Recent board meeting have been about which charity will receive a donation from the club. We have donated over $3,000.00 in 2009 alone. Only to real charities guys so no, you don't qualify!

We had a charity raffle at the Christmas party to raise money, we had a charity car show to raise money and we give it away to deserving charities. Our region only has 175 members or so and 30 or so active members.

Then we discuss the upcoming events and the schedule, and eat our pizza. The president of the regional club has a job at a beer manufacturer. He usually has free samples for the over 21 crowd. There is always some random BS and car talk as well.

I'm a child from a broken family, hell, it broke several times in a row!
i have mental problems for which science doesn't even have a name yet and the only relief so far, not cure, is parts from Stuttgart...

Nobody helps me.

i have to cutback on food supplies to pay for my medicin, while you lot stuff your faces with pizza...

If there was a Porsche parts charity I would be at the top of the list. I am the treasurer and I have the checkbook. I know I have spent more money in parts for my 911 suspension refresh than I did for my brand new 1973 Super Beetle. No club funds were used in my suspension rebuild! Just the bank of Glen.

Don't need a gettaway car, the bank has a 3.2 Carrera.
