I think the rule around here is that if a gun clears leather, a law has been broken by someone. We have legal defensive display, but you will have some splainin' to do if you display. Might be totally legit, as long as someone has given you cause to unholster. But this guy was in the wrong as soon as he put his hand on it. I don't know if I would have drawn down on the guy, though I'm sure I'd have been totally legally justified in doing so. If my wife were with me, I'd get her out of there and call 911. If that guy had pointed at someone, I'd probably have stepped in. BTW, I don't know that I've ever been unarmed inside a Wal-Mart.

Generally speaking it would be unlikely that you would have been justified unless you were pinned in an area of the store where you or others in immediate danger could not get past the guy and get out of harms way. In most circumstances you need to be an unwilling participant; hence if the guy was futzing with it while his back was turned to you and you had every opportunity to retreat- you would likely be in hot water if you opted to hold him at gunpoint.

That said had you done so it would also be unlikely you would have been hit with an assault charge for drawing on the guy, given what he was doing.

Now if he had pointed it at someone, that may be different...

Well, the store clerk said she thought he was about to rob the place. And there's NO justification for unholstering your gun in a store unless you're about to prevent a crime. Any nutbag brandishing in a store can reasonably be considerd to be a threat.

I can make the argument that everytime I'm in a Walmart I feel like I might get robbed. A guy with an elevated voice diving his hands into his pockets might be pulling a gun, or a coupon (playing devil's advocate here not trying to say your remarks are bogus). You have to be smarter than what you're dealing with...

No, you're not legally justified in doing anything because of someone with their hands in their pockets. The law states "which a reasonable person would conclude" when defining a threat of death or grave bodily harm.

Knowing the kind of person i am, i am sure i would have ran my mouth a little at the guy if i saw him constantly fking with his gun in a walmart, or any other store.

There's just NO PLACE for that kind of crap. I've never even seen such stupidity.

I once gave a plainclothes cop a TON of crap in a (traffic) courtroom for sitting in the front row in a folding chair with his glock hanging out of his pants, totally exposed, in no holster. ANYONE in the second row could have snatched it before he would have been able to react.

I gave him so much crap that the judge actually stopped the proceedings and asked what was going on. The judge was not amused, and chewed both of our butts out, but he did give me a little nod after my case was over. You cannot just have an exposed gun like that in a court room that any of the other people in the court room can just walk up and snatch and fire without a single seconds delay.

just today i handed over to my 21 year old son whose going to NAU my HK9mm compact UBERIZED ROBAR'D pistole. why? because upon my orders he would get the gun if he went thru the azccw course. he also had to score 100 on the writtian and 100 on the practical shooting.................WHICH HE DID! and being the proud father that i am, i gave him one of my fave 9mm's with the entire dad speech in depth/in triplicate/8x10 glossys w/pics and arrows describing what the hell this is ALL ABOUT!

now my sons have both grown up with guns since they were out of diapers. i have no concerns of him ever pulling a stoopid stunt like this guy. and i explained to him fully and IN DEPTH, that the level of responsibility is equal to a cops responsibility. and if he screws up in any way they(courts) will drag his balls thru broken glass and razor blades before the fat lady sings.

Seriously, did it accidentally discharge (I would think one shot) or did he shoot multiple times? I just don't see a gun accidentally empty the clip...

Remember, the gun he had was a Jennings, so all bets are off as far as reliability goes. Could have fired on its own or anything could have happened. And yes, the media are having a field day because they are vehemently against the upcoming law allowing CCW without a permit. Any bad gun behavior now will make headlines in AZ.

Yes ding dong- reread the article- that's not what I said. This guy was screwing around with his firearm but not actively pointing it at anyone perpetrating an armed robbery. Just because the clerk "thought she was going to be robbed" does not give YOU the right to intervene and fire upon said individual. That's why you retreat and get the hell out of the situation.

If you're so tough, and quite the literary genius I might add, go ahead and knock the guy on his rear end before he knows what hit 'em.
