Paid for a deposit, but did not get a Porsche! Please read.

Guys,

I bought a Porsche 996 in Minnesota but I cancelled the sale and terminated the purchase agreement that both parties signed.

Dave the seller listed a Porsche on EBAY and described what seemed to be a very nice Porsche (paint in retail condition, no parts missing etc)

We agreed a price and I paid a deposit via Paypal. I only paid the deposit before and inspection because Dave the seller and I agreed via email and in a Purchase Agreement that I would get my deposit back if the PPI report co-insides to his description on EBAY.

Well, the PPI report was totally not the same as his description. The paint and body was not in retail condition (scratches, dents, dings, cracks in the front bumper, ripples in the body etc)
The car also had some missing parts and the computer had about 20 fault codes stored.

The company who did the PPI recommended me not to purchase the car.

OK, I informed the seller. He send me an email telling me that I would recieve the deposit back and that he wanted me to leave a positive feedback on EBAY.

I did leave a positive feedback but I never got the money back

He is not replying to my messages and paypal is telling me that they cannot help me.

Any ideas how I can solve this and get me deposit back. I have the purchase agreement, emails, PPI report. The sellers name, adress passpoort, everything

I hope that someone can help me out

Why is PayPal refusing to help? What is the amount of your deposit?

Two options: Lawyer or pro-per (Small Claims).

I tried paypal, but they send a stupid reply telling me that they cannot help me because the item bought is a virtual or intangible good. Yeah right, I mean it is a car.

I mailed Paypal again but no response so far

Paypal will not 'give' you the deposit back. The Paypal refund policy does not apply for auto or real estate purchases in full, and the intangible deposit paid towards these purchases. What they can do, if you CALL Paypal and tell them you won an Ebay auction (remember Paypal is owned by Ebay), paid the deposit and did not receive the item, is put a freeze on the seller's Paypal account and the $$$ contained within until your dispute is worked out. Then, you have to call Ebay and work with them on their 'Buyers Protection Insurance'. This is buyer's protection is supposed to be up to something like $50,000.00 in protection.

Be patient, the seller will get in touch with you if you do the above.

Paypal

If you used a credit card get the CC company involved Pay Pal s***s for customer service. A lesson for all do not pay for anything without an American Express card. Amex would immediately charge back Pay Pal that gets thier attention.

i had a $2800.00 ebay item not delivered. paypal was ZERO help. my bank bailed me out.
this was really unpleasant. good luck, jp

First off, Why would you send a deposit prior to PPI?

Secondly, Why would you take the word of someone in "Virtual Land?

Thirdly, This is another perfect example of why NOT to buy a car off Ebay.

Sorry, but facts is facts.

If you used a CC to put the deposit down, call them and open a dispute.
