Who is fos here , Carvana or BMW ?

I have a client, super cool guy. He has had a bunch of tuned BMW's over the years . He is mostly DIY, so I usually only do state inspections for him .
A few years back, he bought an X 5 diesel from Carvana. About one month into his ownership, the trans went out of it .
It took him months of fighting with Carvana, but eventually , they paid ( or so they told him ) for a brand new transmission from BMW . It was supposedly a $10.5 k bill .
Fast forward to right before X mas, he lost all his trans fluid. Like spectacularly , complete fluid loss in a few hundred feet . The truck ceased to produce any forward or rearward movement , so he had it towed to me . He showed me pictures of the giant oil slick he left all over the pavement
We were both hopeful that the trans cooler , or lines had failed, but once I pulled the under trays off, I could see that the fluid was coming from the pump/convertor area .
After a few weeks of fighting with BMW and Carvana, they both told him to pound sand, it was no longer under warranty .
Today, I pulled the transmission and to my surprise, it was not a new unit, but a used trans from a salvage yard . The yards name and mileage was marked on the top of the bellhousing in that grease paint pen that all salvage yards lie about mileage with .
So who would you guys suspect to be the liar here ? '
My guess is Carvana.

I just worked with a guy who did a recent Carvana commercial. He said it was extremely low budget and they were trying a last gasp ad blitz.

His take was that they are "on the ropes".

Sounds like it was out of factory warranty, when he bought it did caravana provide some kind of warranty?

We have a Carvana "vending machine" along one of the busy interstates here in OKC in a busy retail area. I have glanced over as I go by at 70 MPH (the legal speed limit) and most of the time there are virtually no cars inside the big box. At most two.

I just wonder what will happen to to those large glass boxes when they fold. It would suck as warehouse space with everything exposed to sunlight, and hell to keep the temps bearable for any human to work in there.

The local Metro Detroit Carvana has just had their dealer license rescinded by the State. They've been on probation basically since they opened. Their list of issues includes:
- "Carvana admitted to violating a probation agreement, improper use of temporary registrations, inability to provide records in a timely manner, failure to submit applications for buyers' title and registration within 15 days, and failure to obtain odometer disclosure records."

Best thing to do now is invest in a BMW (as in from them directly) replacement trans whether new or reman. I can tell you from experience that every auto trans that we installed that was not from BMW had a problem. EVERY single one. These were sourced from 'reputable' reman builders, some that may sound familiar. Because the warranty companies would not pay up for one from BMW.

Your client takes the hit once, then no worries till end of vehicle life. As for Carvana doing anything, even with a warranty that is in service - good luck. They are laying people off, performing almost no actual check-overs / PDI's, addressing issues before resale. The sharks are circling .................I wouldn't waste my time, they will just keep stalling.

Trying to get a resolution from Carvana will be nothing more than a time wasting effort in futility.

Those guys are shady as **** and their back office is a complete utter mess.

They can't even manage title transfers on vehicles.

Best use of time is trying to sort a way to fix the customers car with the least amount of financial pain as possible.

There is already a very long line of people trying to get settlements from them.

They don't care, they know their days are numbered and it's honestly not in their best interest to deal with this so they will simply avoid and delay until it's no longer an issue.

My guess is Carvana.
I came very close to buying a car from them last year.

In fact I technically had but unwound the deal at the last minute.

Why?

Because they are lying sacks of **** and not even very good at it.

There is no "guess work" involved with who is FOS, it's them.

I sold them an S60 T8 plug-in hybrid a few years ago. I was one year into a three year lease and they handed me a check for $1,800. I was running hot on the miles, too. Could have gotten another one for the same payment and kept the $1,800 (I worked at a Volvo dealership), but a Tesla Model 3 had a lower net cost factoring in gas (I drove well over the battery range on the S60).

I would have never bought anything from them knowing how much they stepped on their dicks overpaying for cars. I hope nobody gets burned by them, but that doesn't sound realistic, even if they have insurance or bonds that would kick in.

My family has bought 3 cars from Carvana within this last year with zero problems. LOVE the process.. Even sent one back and chose another model. All worked perfectly as advertised.. I hadn't heard that they were in financial array.

Carvana is potentially just months, if not weeks, from bankruptcy. Gross margin is nearly zero, and at the bottom line it loses several cents for every dollar in revenue. Cash on hand is equivalent to only a few quarters of negative cash flow. The debt is 6X the stock value and that debt is selling at a deep discount. It will likely be a planned BK, the creditors get the company, stock is wiped out, the company keeps running or trying to.
