Fint, Joe never even sent a check to any third party at all....which was also part of the deal....

How could he have done these things according to a plan to "save face" from this bet if these things were done before the drama even started?

The "deal" was that Shaun would confer with Joe and they would jointly decide who would hold the funds. Shaun changed his mind and sent them to his choice....without consulting Joe. Joe offered to send his money if Shaun would contact him and make an agreement on where to send the money, but Shaun was so sure of his bet that he did not care and ignored Joe's attempts (he said just be there)....and embarked on another marketing campaign to advertise where he would donate Joe's check. Joe was there with cash in his hand....Shaun sent a bad check. You decide who did not follow the "deal."

Was it that big of a deal to send it to Luber? Isn't that just splitting hairs?

That whole part of the argument was so goofy.....

No, it is not. Shaun set the "deal" about how they would determine who would hold the funds and then broke it. It was clearly an attempt to jerk Joe around. Joe was correct to insist that they stick to the original deal because Shaun had already made several attempts to change the terms of the bet in his favor. If Shaun had been operating in good faith all along, Joe would have probably not cared....Shaun had already been acting in an untrustworthy manner..

But part of the deal was "who would hold funds" and no one held Joe's. The deal wasn't "cash on hand once there".....
