Habeas Corpus

Who needs it anyway? Apparently GWB finds it a nuisance.

"The writ of habeas corpus in common law countries is an important instrument for the safeguarding of individual freedom against arbitrary state action."

I guess if you want to catch terrorists you gotta act like one.

Yes, this "conservative" president is busy giving as much power and control to the government as he can before he leaves office.

Statement by a statist aside. Habeus corpus was ended by Lincoln and the Lincoln cultist have justified Bush II's ending it as well.

In fact, they've justified Bush II doing many of the unConstitutional acts Lincoln engaged in.

Dam shame that Congress and the President took control of war policy and power from the judiciary. Dem or Rep doesn't matter. The judiciary lost its power grab over WW2 precedents.

The Far Left and the ACLU must be depressed that the Supreme Court lost control of terrorist policy. Even the mass media using it as a vehicle to create Rep infighting failed.

Screw judicial supremacy, power to the people.

before slamming me don't forget to read the NY Times for your talking points.

Yes, and it's very good that most of the American citizenry are armed.

And will resist this tyranny.

You really haven't thought this out thoroughly have you?

meaning if you are at war with the US you'd better have your act together instead of an ACLU lawyer ?

I was gonna comment, but I see the guy who can't seem to type a post without the letters A C L U is here making his usual sense.

There's a pretty good thread on "Torture Law" that goes over this ground pretty throughly. Its shameful, 800 years of jurisprudence out the window with a single pen stroke. And no one seems to care.

Yes, that's correct. That's been correct for 140+ years.

The US Supreme Court ruled in 1866 that the executive branch could not suspend the writ of habeas corpus as long as any US court was sitting.

The courts have been stripped of habeas corpus jurisdiction over enemy combatants.

Then again unless you believe in judicial control !

I'm surprised there isn't more outrage about the suspension of HCorpus. Guess people are too apathetic or they buy into the arguement that if you've nothing to hide, abridging freedoms is OK.
