Title problems

I bought a car from a guy in Wv. The bank had to be paid off and i was supposed tp be mailed a title when he recieved it. Its been almost 2 months and i still don't have the title. I have a bill of sale, along with all of our emails and i payed him a deposit paypal. he gave me a copy of the title when he bought the car (from previous owner) Turns out he never recieved the title from who he bought the car from(he only onwed the car a few weeks), is that fraud to sell a car that he didn't have a title for??? I spoke to the guy that was supposed to give him the title and says it'll be on the way. I have ways i can get a title for the car ie mechanics lien, or having it towed to a buddys tow yard and buying it after 30 days but i really don't want to do that What can i do?? Is that fraud on the seller who i bought the car from??? Thanks in advance

Your contract was with the last seller, and that's who's responsible for it.
I would push the issue asap. Take all your evidence and apply for a duplicate title from your DMV. Witnesses of who you talked to etc...
No title given, then small claims, state attny general, BBB(a joke), etc...

Since it's interstate commerce, it's not just state fraud, it's federal fraud. Tell him you will call the sheriff's office to ask him to impound the car pending adjudication of ownership, which will tie it up but good. Do your homework, study the law, and take action. I had to go down this road partially over a car I bought in Georgia. Got rather ughly until I started talking law enforcement, that changed the seller's tune but quick.

ok thanks for the advice guys. i talked to my DMV (fl) yesterday, i can't do anything through them, car wasn't been titled in florida or in my name so thats a no go. I could do small claims etc etc but what state do i have to do it in??? If this drags out to much longer i guess i'll have to call the sheriff's office in Wv and see what they have to say. Any lawyers in Wv???
