Ok ..Im P*ssed off about insurance Adjuster
Long story short... Wife was in an accident 2 years ago.. Not her fault. Car was totaled. She was sitting still and was broad-sided.
The othe parties insurance company is STILL being unreasonable and not wanting to pay the $35k in medical bills, (well, mainly the adjuster) We have had 2 lawyers.. the first was taking kickbacks from the ins co....so we changed lawyers. The second was supposed to be a real shark.. but is also a moron. (he sends letters out to the wrong parties.. cant get anyones name right in documents..that sort of thing) So we have paid the medical bills out of pocket because at the time we didnt have health insurance. Anyhow.. today we get a letter from the Insurace adjuster.. and it states that he thinks shes making the whole thing up. (granted she coudnt walk for 3 months... and has had uncontrolable internal bleeding) and said hes demanding she go to psyco therapy to make certain shes not making up, then he will offer $5k to settle it. What as ASS! Im so mad I cant stand it. Heres my solution which I have already run by my business lawyers.. and they blessed it under certian terms. Im buying a POS van and going to vinyl wrap it with this a-holes pic on it and something that says : This insurance adjuster (name and company insert here) has treated us poorly, and we need to let him know we are not standing for it any longer" .. and put a website up with our complaints and ask people to actualy sign the van. When I get 200 signatures..Im going to call the news and park it on public property in front of their office. According to the attys..as long as everything posted is factual.we are ok. Im soooo tired of dip***** people not acting professionaly. All we want is whats entitled under the law. Not even asking damages. In the mean time.. we are going to court..which will take a few years here in NC. Any suggestions? We cant seem to get anyones attanetion at the ins company... they wont discuss any case except through the adjuster.

Hire a good lawyer on a trustworthy recommendation.
Sue the at fault party. Don't even bother talking to the adjuster. Have your lawyer write a letter to the insurance company outlining the bad faith negotiating tactic he/she used. Send a copy to your state's insurance comissioner. This is a no-brainer for competent local counsel.

A couple of guys have already chimed in, but I will repeat what they said. Sue the at-fault party. Let them deal with their insurance. At the end of the day, it is their responsibility. If they want to go to their insurance to cover it, fine. That is their option. Let them deal with it.
I have been hit twice in the last three years by folks who have elected to save a tone of money with Geico. Neither was a pleasant experience. From now on, I will simply go after the at-fault party. I should not have to deal with their shady adjuster just because they want to save on insurance. They are effectively pushing the burden of doing this off on whoever they hit. I, for one, have decided "never again".

Yep, you need a better lawyer, one with his ***** together. This is my dad's area of practice (no good to you, we're in Canada). 1 of 3 scenarios is the truth: 1. you/your wife are lying or grossly exaggerating and don't deserve anything, 2. you/your wife are being completely truthful and not exaggerating and you deserve compensation, pain and suffering, medical and legal expenses, etc or 3. the truth is somewhere in between. I don't offer option #1 to be a jerk, just to lay the facts out on the table.
In my (albeit limited) experience (I used to do summer work at the firm all through university and grad school) insurance companies at first will always lowball, but they're also good at smelling a fish. This means that a lowball offer to settle should be expected, but if you fight and they fight back hard there might be something there. Generally, it's cheaper to pay out a $35K claim than to settle for $25K plus both sides' legal expenses. They have top-notch legal representation, so should you. The shark moron sending letters to the wrong people sounds like Jackie whathisname from Seinfeld! Not who you want batting for you.

Insurance is such a goddam scam, anyway. I feel bad what happened to you and your family. What's the point of paying insurance if when we NEED it, they blow us off. doesn't seem RIGHT. |

Dave, let me start this off by stating I am an attorney in Missouri, not NC and I don't know NC personal injury law. But perhaps this will be of some help. First off you should get rid of the attorney you have and get one that knows what they are doing in the field of personal injury. The attorney you use for business law should be able to give you a good referral. Second, has your attorney sent a demand letter to the insurance company to get them to pay for your damages? If not that needs to be done immediately. In Missouri interest does not run on the dollars for damages until the demand letter is sent out. Third, after two years of a run around by their insurance company your attorney should have by this time sued the party that hit your wife's car; that is the driver of the car. Finally, if you had full coverage insurance at the time and need the money now, make a claim with your insurance company for the medicals. If they pay up they of course will be able to get that money back from whatever settlement you get from the other side's insurance company.

Kurt and most of the above are absolutely right.
You have to get a lawyer who specializes in auto accidents. Don't go to a general business lawyer who also does personal injury if it comes in the door, don't use a general practice litigator who dabbles in personal injury, don't use a commercial litigator who says "sure, I can handle a personal injury case". Get someone who does only plaintiffs' personal injury/auto cases. Someone who specializes in your kind of case will make short work of the adjuster.
