This is the down side to cops' well known penchant for escalating searches to the most extreme entry possible. Had the cops walked up to the door and knocked the homoeowner wouldn't have shot. I know there are situations that call for true no-knock entries and full swat teams, but those are few and far between. It sounds like this guy didn't even get charged with anything else. Maybe they had the wrong house. Remember the 80 year old grandmother who killed a cop a year or so ago? I think she was not charged.

Yeah, I think there more to this story, like the other side.

Two things come to mind; I am surprised they got a search warrant for the premises based on a (snitch) CI seeing a "couple of plants in the back yard". And, what about the college student who got killed looking for a halloween party, and knocked on the door, and as walking away, was shot and killed by the owner.

No more guns!

In the case where a citizen mistakenly (and allegedly) shot through his door at a raiding police officer, the citizen is facing a murder charge; in the case where a raiding police officer mistakenly shot through a door and killed a citizen, there were no criminal charges.

Of course they are refering to Peyton Strickland, murdered by a sheriff's deputy who fired through Peyton's front door and into his home. Also from the article:

The raid in Chesapeake bears a striking resemblance to another that ended in a fatality. Last week, New Hanover County, N.C., agreed to pay $4.25 million to the parents of college student Peyton Strickland, who was killed when a deputy participating in a raid mistook the sound of a SWAT battering ram for a gunshot, and fired through the door as Strickland came to answer it.

I'm here to tell you, as a lifetime active shooter, THERE IS NO WAY IN HELL DEPUTY LONG "MISTOOK" THE SOUNDS OF A BATTERING RAM RIGHT NEXT TO HIM FOR GUNSHOTS COMING FROM WITHIN THE HOUSE. I cannot believe his lie has been perpetuated and has now become "the truth". Just a "mistake" my lilly white ass, but I digress...

So now the tables are turned and we have, quite tragically, a dead cop. Now we get to see how the legal system differentiates between its own, and just us common citizens. You know, the ones they are all sworn "to serve and protect". They will go after Frederick with everything they have. They yawned and said "oops" when it was Long.

Based on the info in the story, I would side with the homeowner. I hope he gets off, and then successfully sues the police department.

You might be surprised, at the truth! Happens commonly. The kid who got shot in the Halloween costume was walking towards a guy standing in his front door with a 44 magnum. The guy told him to stop repeatedly. He eventually raised the gun & yelled at the guy to stop. The guy kept coming. He got shot. The kid didn't speak English very good. My question is, if you are on Mars, and you are walking towards a Martian w/ a 44 mag in his hand & he's barking something in Martian, are you going to continue walking towards him?

Story sucks in so many ways.

Sucks for the cop who was doing his job.

Sucks for the guy jail.

Lives ruined all around due to what sounds like a lapse in judgment on someones part.

Woulda happened the same way at my home.

I do like to think i'd tell the bad guy that i have a gun and will be using it if he doesn't vacate immediately but it's gotta be one heck of a scary thing to have somebody busting through your door like that.

****ing over-zealous dirt-bag soldier of fortune meatheads got no business wearing a uniform and carrying a gun.

The kid from Halloween is big time over here in Japan. The Japanese use it all the time to say that guns and America is bad for you.

The claim was that the kid thought the home owner was lieing to him about the party not being there. He thereby went around to the back side of the house ... ( I do believe that is the I heard it).

The J's over here claim that he couldn't understand the difference between "freeze" and "pleaze" ... then they go on to say that he thought the gun was part of a Halloween gag or something.

Oh pleaszeeee!

I'd like to see the guy defend his decision to allow a no-knock on a suspected pot dealer. ****ing POTUSes have been cokeheads, potheads and otherwise morally worthless people yet this guy gets his house broken into over pot.

I hate the stuff and what it does to people but this is utter ridiculousness.

It happened in Baton Rouge. There were whitenesses. The kid was going in the guy's back yard & the homeowner came out, with 44m & asked him where he was going. He turned & started waking towards the guy talking broken English. The guy repeatedly told him to stop. Backed up into his doorway, raised the gun, all the while yelling stop. How does that not translate. I'm guessing the homeowner wasn't smiling as he was doing this. The kid had to be a moron.
