Call the health department and report a potential violation. Health inspectors can (and sometimes enjoy) make life hell for restaurant owners. Sounds like this jerk needs to have his chain yanked a bit.

"Well were closed" says the guy.
"What time do you close?" I ask
"9:00 pm" comes the answer. Just then the traffic report comes on the radio (Every ten minutes, this is the 8:50 spot).
"My clock & the radio says it's 10 to"
"Well it isn't" he says. Click, end of conversation & the lights in the drive-through go out.
As I leave you can plainly see their wall clock ..8:51.
Slightly off-topic, but heck, this is OT, afterall. In a hospital where I was working, the cafeteria staff pulled a similar one on the new hospital CEO, who was trying to grab lunch 15 minutes before the cafeteria "closed." Starting the following week, the cafeteria remained open--not just for the full duration of breakfast, lunch, and dinner, but in between (albeit with reduced services), as well.
