Hey Jim C

You do work for builders, correct?

In NY seller pays for survey.

Buying a new place in TX and the builder does not supply the final survey. I need to pay for it, $500.

A) I feel if you are building the thing and selling it the survey is your problem.

B) That's an expensive survey. I've had em done, as recently as 6 months ago, for a lot less.

Thoughts?

I'm in almost the same biz as Jim. (civil engineer)

You mean the builder/seller does not have the final permit on the house yet? Be very careful about buying a house before the final is issued. If the house is over a setback line, some (probably most) building departments will make you tear down the offending wall and re-do that entire part of the house, foundation and all. I've seen it happen.

I've also seen a house that was 6-inches too tall, and they had to remove the entire roof and a steel moment frame at great cost to make the house 6 inches shorter.

The seller should pay for it. If not, at least get the survey done before close of escrow.

Don't remind me.

The house I sold in NY was permitted as a one story but I had bed/bathrooms upstairs.

Builder pulled a fast one on the permits.

Sold the place in November, had to hire an expeditor to get all the permits sorted. Still not done and the buyer still has $10k of my money in escrow.

Suing the builder and my former attorney to recoup the $8k it cost me to cure.

I would bet the builder has to provide a final "as-built" survey to the building dept to prove it is in the correct location. I know I have to on commerical projects.

As far as the final permit, where does he say he doesn't have a permit?

Isn't it a buyer's market up there? Can't you get them to do anything you want?
