eh, dont be to sure about that...technically yes, but it was their convention.

esample gave the best description of what goes on in these situations, however if the song had been used as part of the campaign officially....then the songwriters WOULD have rights beyond ASCAP's "blanket liscense" for arenas etc. My guess is that Heart does own at least part of the publishing which is why (other than the benefits of publicity and political posturing) they are making the stink.

They did not need Heart's permission to play it. They paid for the right to play it via ASCAP, just like anyone else would...sheesh. Unless, Heart had some special freaky contract with ASCAP which only allowed the song to be played in certain venues for certain purposes...then they don't have a leg to stand on. If they did, we would have already heard about it and Heart would be suing ASCAP instead of whining to the Daily KOS.

2. AFAIK, political parties do not broadcast conventions...perhap you should be suing CNN or MSNBC

Here's the problem I have:
"Copyright law may not be on the Wilsons' side as the song is licensed for public performance under a blanket fee paid by the venue to ASCAP, the firm that collects royalties on behalf of composers and copyright owners."
How can we be sure the GOP Convention is a public performance? To me, the convention seems more like a private convention that was publicized to the public. After all, weren't people, such as delegates invited to the event? Not just anyone could show up off the street, right?

My understanding of the word "broadcast" when used as a verb is: "to transmit (programs) from a radio or television station."

1. Heart did write the song. That's verified elsewhere in this thread.
2. The convention had reporters from various networks present, and those networks did broadcast from the convention, but no network exclusively "broadcasts" the convention. That was the GOP's job.

If a law was broken, don't you think the Wilsons, who apparently do not support the GOP, would have sued?

Your point is moot. If it were a private performance, the GOP would not have to have paid at all...any more than you would have to pay to play records at your private party.

That's exactly where you're wrong. A private party in someone's basement is much less likely to be broadcast to 80 million viewers as is an event such as the GOP Convention.

A private party and the GOP Convention don't really compare. One reason is the video cameras.

My bad...I meant the Wilsons did not write it...they were co-authors with two other band members...who were "thrilled the song was used."

The GOP does not have the means to broadcast anything. The networks broadcast it.
