What could be a good enough reason...

...for a pair of police officers who witnessed a car accident that ended in the death of one of the victims NOT to show up to the manslaughter trial?

My friend Roger, married in February of 2008 was killed in late August of the same year in a head on collision at 5:30am on the way to the airport. His wife, in the car with him suffered her own injuries but Roger's injuries were significant. A few days later he was removed from life support.

Roger was a good man, no - a great man. The best kind of friend a man could hope for and his wife, man I feel for her.

The first set of charges were dismissed. Apparently all of the subpoenas were not served and for whatever reason the police officers could not make the trial - the case of course depended on their testimony that they saw the driver and witnessed the accident.

The second trial, dismissed again - lack of witnesses to put this guy in his car.

He gets away with it - completely.

Most of our friends blame the legal system as a whole, I am not willing to go that far. I lay the blame on these witnesses, my understanding is that they new of the trial and that they needed to be there. They weren't and because of that - this guy gets off.

It reeks.

What are the circumstances that brought manslaughter charges? Sounds to me like the local newspaper and TV news hounds should be made aware of this. If there is any evidence of mishandling the legal process, they may find it.

And, this might bring an attorney out of the woodwork that will take the civil side of the case. I do believe the officers will be required to testify at a civil trial if properly subpoenaed.

The police subculture has 3 norms. Solidarity, Secrecy, and Silence. As William Wesley emphasized, these points are usually confined within the subculture, but sometimes they can overlap. Someone knows someone, and something does wreak.

Most of the time the subculture protects their own within the subculture, this appears that it was extended.

It's BullS**t. Start making some calls. Lord, there should be enough attorneys on this board to at least provide some direction. No way that person should get away. Arguh......what in the H**l is going on around here? (USA). Politics, bribes, favors, money, suggestions, blinders, conservatives, liberals, no account, do nothing, worthless, pieces of s***. And we vote for these people that make these 'laws' that allow this to happen?

Gotta stop, I hate when this type of stuff happens! No sense in starting a rant (even though I agree with you).

Funny I don't see any of the cops on this forum sticking up for this guy who didn't show.. That should be a firing offense.. Of course if it were a traffic ticket they would have called and had it re-scheduled.

I always thought if a case was dismissed, it was over. Can't be tried again because of double jeopardy? I'm no lawyer, but that's what I thought....

1) Manslaughter is a criminal offense. This was a criminal case.
2) Civil remedies are still open. (Remember OJ?)
