Oldie but goodie. But that guy talks as fast as the guy on the old Federal Express commercials. He's 100% right. The only time I'm ever talking to the police is if I'm the one who calls them or I witnessed something that I had nothing to do with. I watch Forensic Files and Cops all the time and it's just amazing how many idiots talk their way right into jail, when the cops would have had to let them walk, had they kept their mouth shut. If you're suspected of a crime and the police ask you to come down for questioning, how in the world can you possibly help yourself by talking to them? No one has ever talked their way out of being a suspect.

Funny thing is I have friend that's a public defender that used to tell me the same thing....then also give me examples, right down to being stopped for speeding.

One of my good friends from college is a NY State Trooper. He advised me to respond to any of the self incrimination questions ("Do you know how fast you were going" etc) with a winning smile and a response of "How can I be of assistance, Sir?"

I was on a jury for a harassment case last year. We found the guy guilty. What did him in was his own big mouth, both talking to the police and testifying without a lawyer (duh) during the trial.

If he had just kept his yap shut he would have been much better off.

That's right. You have the right to remain silent but like most rights, you can waive it. My dad was a defense lawyer and that was always his biggest piece of advice: "Keep your friggin' pie hole shut!"

In tax cases, there is an old axiom: R+C=J. Records+Cooperation=Jail. Keep your mouth shut. Don't help them with their investigation into you. Cops themselves follow this advice to the "T" when they get accused of wrong-doing. If they're smart, they lawyer-up and shut-up right away. They know better than anyone how people convict themselves.

If you are smart, you say "Trooper". If you are even smarter, figure out how to read the stripes on the uniform and say "How can I be of assistance, Sgt?", etc.

My brother is a retired cop and I said nobody should talk to a cop without an attorney. He got pissed at me for it.

Many cops do, and will get pissed if you don't answer them. These are either the crusaders who actually believe they're the good guys. The ones that "want to make a difference," or the total "respect my authoritay" control freak types.

Not answering can cause you a LOT of grief too, but it's still better than talking to them.

If I get pulled over on my way home from work today and I don't say anything... wouldn't something small turn into a big deal where I risk being tazed, dragged from the car, car searched, towed, whatever.

How does one tell a cop that you do not intend to speak to him?


I watched the entire video, it was very interesting! comparing what the atty said to what the police officer said.
