I'd just have some fun with it if I were the car owner. Maybe contact the press, get some publicity, have your 15 minutes of fame. But I'd string it out for a while, and have some fun. Because this idiotic judge is in a box that she can't get out of and will lose in the end and any fines/fees the owner has to pay will be reimbursed to him.
One thing the guy could do would be to file a complaint against GM for indemnity. That'd be funny and would get a lot of attention. After all, there is a ruling by a "judge" that says that GM has now sold thousands of vehicles that are not in compliance with a whole host of laws. GM would be responsible for any damages, fines, fees, etc. incurred by an owner of one of these "illegal" vehicles. |

Guys, I totally agree with the judge and love her opinion!
Now that I know that state or municipal courts and law trump federal law, it makes sense! Now we can prove that the AZ law 1070 regarding illegal immigrants is legal and that once again our state law trumps federal law! Course in our case our state law against illegal immigration is EXACTLY the same as the federal law but these idiots cannot see that....

Besides, those tail lights look like ass. No wonder Pontiac is history.
On a side note, think of the implications of this if the courts rule the other way - if local/state governments CANNOT either supersede or add additional provisions to federal law due to preemption (either as upheld in this case or the AZ 1070 case) what does that say for all the local/state gun laws? Bwahahahaha!

![]() Truthfully, I totally disagree with this judge. That said, we in our town, counties, states and so on at some point in time are going to have to take a stand and tell the feds that we have had enough. They forget at times that they work for us, and not the other way around. Both the fed and state as well as county and city have laws out the wazoo, and if they are not being enforced and the public is at risk, its time for someone, anyone to step in and stop the "passing of the buck" so to speak. This judge is clearly wrong about the entire range of cars. She very well may be totally correct about THIS car if its been modified. In the same vein, AZ 1070 exactly mirrors the same federal law regarding illegals. Its not about the law, its about enforcement, and here in this state and the three other border states, the federal govt is doing a terrible job. We have parts of our state that are now considered off limits as its simply too dangerous for un-armed citizens to venture due to the illegals and their "shoot with no questions asked" policy. If the fed govt cannot or are not going to do it right, then its time for us to step up and keep the public and this great country safe. My 3c worth... Joe A

You are a few weeks behind - the SCOTUS ruled on McDonald vs Chicago that the 2nd is incorporated against the states via the 14th... of course, Chicago and everywhere else is just writing new laws, knowing that it will be years before it cycles thru the courts again and is overturned again.
