Landlords, Should I pay back the last months rent?
In December she says she is moving out the first of January... so I wasn't expecting rent for Dec. because she paid first and last... but then I get a rent check in the mail, so I presume her moving out plan has been delayed.
Not so, she has moved out... and asking me to pay her back the last months rent. I fell like the fair thing to do is give her back the last months rent. What say ye?

If she paid twice for the same month, (first and last) pay her back.

She can turn around and sue yer ass. It stays on your tax record and you then need to clear it to sell your house. Unless she trashed it...give it back.
Renters have a pretty good set of rights.

Of course you would pay her back. What basis is there to keep unearned monies? Now if the facility is damaged or you have other reasons then so be it - but if its strictly rent unused you must return.

I am not so sure I understand your situation clearly, but I would err on the side of caution and wait until she has vacated, and see what sort of shape she leaves the place in before I refunded any money. Cover your arse my friend.
We are in the process of buying a property, and there is a $4800.00 dollar lien on the place . The last tenant ran up a huge water bill and stuck it to the landlord. I would want all of the smoke to clear before I made any decisions.

Looks pretty basic to me. Just wait until she moves, check to make sure there are no issues you need to repair that are her responsibility, then give her back her deposit and last month's rent within 14 days of her vacancy. You are a lucky guy to have a good tenant. See if she has any family or friends that need a place. Perhaps they will be honest like her.

Avoidable if you charge your tenant(s) a refundable security deposit up front. In CA, you can charge the equivalent of one month's rent.
If the amount you have is all you've got, make sure the unit isn't damaged, and if so, deduct the cost of repairs from her payment, then provide her copies of the repair invoices. What's fair for both should be fair. Sherwood |
