my neighbor is making me insane.
they have an enormous tree. it overhangs into my yard. the tree is very messy, but provides great shade in the summer. he elected to have it cut down. this is in our backyards. they hired some non-licensed idiot. the guy has been using an extension ladder set up on the ROOF! no climbing gear. he broke our common fence (that i paid for). the idiots set up lights and cut into the night. he said he will fix the fence, but we will see. i guess i should be happy he didnt drop a limb into my kitchen.
then the lady of the house. i recently redid my front yard. i build a parking niche for myself to get my truck partway out of the street. my street is a tad narrow with street parking. i used decomposed granite in the niche. the lady loves parking on my yard. i wouldnt betch to much, but she cant get it through her head to not turn the steering wheel too much while up there. she digs into the granite,,and i have to retamp it. i am gonna spend sometime and put some ornamental rocks out there. my truck has the ground clearance..her odyssey..not so much. i almost came out shooting when that tree fell into my yard. it took out 30% of my lime tree. i had to trim all the broken limbs out. it now looks retarded.

I found it was useless to be kind to my neighbors. They just too took it to mean I was a push over and continued to be disrespectful to my property. If they don't respect you, no need to respect them. So I got mean and they got the message. Besides I didn't need friends like them.
Of course you can solve your neighbor problems and just move out to the country ![]() |

I agree on this point of view but you should maintain the high ground. I would make a deal with them and stack the majority of the fire wood on your side of the property (if you want firewood). The parking is yours so tell them so. There is no reason to let them use it as theirs. The damage to the fence and trees should be discussed as well. This sort of situation has been going on ever since people had neighbors. A neighbor needs to maintain respect for fellow neighbors and obviously they don't respect you. The respect can be returned if you restore it but holding your tongue will only allow this sort of relationship to continue. Pointing out their faults by asking what they would do if the tables were turned would be an effective way for most people. If you have a neighbor like mine it may be that they are not capable of comprehending and must be dealt with like a red headed stepchild. Make demands, make threats, and act upon those threats always. in that order giving time tables for compliance. Uhhh, legal demands and threats of course. |

The neighbors Homeowners insurance will pay for the fence, the lime tree, clean up and Vash's house if the big tree falls on it. Stupidity is a covered loss even if you hire it. |

The city or police "ain't gonna do crap. They might shoot you for wasting their time. The time they can spend waiting for speeders under an old Oak tree. At least our cops down here anyway.

we survived without anymore excitement. now the fence; i have an OCD issue. i see it and it makes me anxious. so i know their casual "timeline" will not satisfy my "timeline". it is a few con-common 8" wide boards, a few nails..should i just fix it? would you?
i let it just sit, and it could be weeks..and i bought the wood from some lumber store. my homedepot doesnt carry 8" wide fence boards.

I have some OCD tendencies myself and have the following suggestion.
If you can't stand the sight of the fence, fix it now yourself and forget about. Cost of materials is chump change compared to being bent out of shape about it. You can bill them for the materials, but don't expect payment. Seriously, fix it and walk away mentally. angela

Vash's HO company would then surrogate (under the liability portion) of the the neighbors HO policy and the guy cutting down the tree to collect their out of pocket money and vash's deductible. If the neighbor and or tree guy do not carry insurance Vash's company may elect to go to court and get a judgment. At that point they could either lien property or garnish wages. The deciding factor Vash's company would use to determine subrogation or a judgment is cost to do so. Will it cost more to collect the money then they would collect? In any event Vash's company would repair his property. As I said stupidity is a covered loss. |

If you make a claim on your property insurance, aren't you at risk of YOUR rates going up and/or being dropped/blacklisted?
Another case of "even if you're right, you're wrong". I'd seek legal remedy - seriously. It's a waste of time and energy to do things courteously in most cases or to deal with people directly/man-to-man anymore.
