Varies from state to state, been on the books in Michigan since 1931 as a felony.

This is going to be a misdemeanor case, to elevate to felony you need a prior conviction of same. With a good lawyer , it may even fall under a hunting violation.

Some punishment and serious counseling is needed in this case. One shouldn't confuse the fact that he did it deliberately. It wasn't an accident. It reminds me a bit of the kid that was caught beheading and disemboweling neighbors cats in FLA. - if it was my kid... Thats a tough one...I won't tell you what I would have done if it was my animal...

Deliberate is not a fact. Its an opinion. Intent is going to be the issue. Seems they might have had a concern for the ducks wandering in a busy parking lot. Whats the lay out of these parking lot? You guys read three paragraphs of a news article and you are hoping he gets raped in prison.

It does make a difference to me whether it's a duck or a snake. I'm the product of thousands of years of Judeo-Christian training. If a duck had bade Eve to eat of the tree of knowledge I might be rooting for the snake, but snakes have carried a connotation of evil for thousands of years and ducks are just annoying.

A felony? That's crazy! But I suppose that's the place to start negotiations and go for stiffer misdemeanor charges/fines. On a side note, he looks like a duck to me! Maybe it was jealous rage? HAHAHAHA!!

The guy probably can't even see the ground from the Hummer. If he'd been really trying, he would have gotten all eight of the ducklings dont ya think?

We used to reserve felony charges for serious crimes.

The United States now has a greater percentage of its population incarcerated than any other developed nation, and most "undeveloped", third world nations.

Being an absolute flaming ass hole is not a felony. It's something, but it's not a felony.

I like Paul's suggestion, but I fear caning may fall into the "cruel and unusual" part of the gray area. Is it a felony, no. Horrific, yes, more importantly I think is what sort of person this young man appears to be.

Indicates to me that the kid is a bit of a sociopath. Say he drives away, rather than back and over the ducklings. Does he come back later for the people who stopped him from snatching a few?

If he is willing to run them over if he can't have them, WTF was he going to do with the ones he took anyway?

It is true, mean people suck.
