How do i get my hvac money back?

I had a Mitsubishi ducted split heat pump system installed about a year ago. It has never worked properly, the A/C is insufficient, the heating is erratic and its just a pain in the butt. It has been looked at by a mitsu rep who said they are working on a fix but that was months ago. It was installed correctly by the local HVAC company. I would like to have it removed and have a traditional heat pump installed, this one cost me almost $15k. Do any of you lawyers out there have any suggestions on how to get my money back? Do i sue the installer or Mitsubishi? Can i win? How much will it cost me if I dont win? Thanks

I am not a lawyer, but I know you need one.

First the lawyer would write a letter suggesting what will happen if you do not receive satisfaction.

Oregon has a procedure via the Construction Contractor's Board that does not require an attorney - it is mediation basically. 1 year limit.

Maybe Wash. does too. Work fast.

Also, complain to the contractor and see what happens -- you can tell them you will file with the Wash. Attorney General's office too.

If the cost to fix is less than $10k then an attorney will not help you much due to the cost of paying one.

If you have two uncles - one of whom is an attorney, and the other is named "Luigi" then you are in good shape.

Good luck but I have to ask, how does the bill for a HVAC run up to 15K ??? Did they use gold plated lines ?

Work fast is key. If you're outside a year I bet you are hosed. Have you even talked to the contractor yet? Maybe they'll come back out and make it right? Better question - if the system hasn't worked right, why did you wait a year?

Not certain about Washington law. Look at the Washington L&I website, there may be something there.

I would certainly hire an attorney on this.

Another option is to post something on the Misubishi facebook page. Just a comment. You want to use the "@mitubishi" in the comment to get their attention. Companies don't like this. Bad PR is EXPENSIVE.
