Contractor's Materials Rain-Damaged

We hired a general contractor to do some basic remodeling for our house. The scope of the project was to remove two doors (one interior and one exterior). The description of the work is as follows: "Remove side exterior door and enclose outside with General Shale Tudor Spalding brick with buff mortar, and inside with sheetrock, paint and pine trim to match existing. Enclose interior door between bedroom and office with sheetrock, paint and pine trim to match existing. All materials and labor included."

We signed the contract on 1/08/13. The first workers showed up on 1/21/13 and removed the doors and installed sheetrock. His brother arrived the next day and finished the sheetrock. The bricks and mortar material were dropped off by the general contractor on 1/30/13. He placed the bags of mortar in our yard and loosely covered them with plastic. Later that evening, we had a big rainstorm with lots of wind. The bags of mortar got thoroughly drenched and now appear to be unusable. The brick person has not yet shown up... My question is simply this - which party is responsible for the replacement cost of the mortar?

A good contractor has insurance to cover the cost of damaged stored material.

As a contractor I would never call my insurance for any thing near the cost of 2 bags of dry mortar.My guys messed up a window and I gave the owner $200 to replace the window. Everybody was happy. I carry 1 $Mill and I never want to use it.

Just quoting for an insurance issue.

It's pretty obvious that this contractor's level of professionalism is questionable.

Agreed, a good contractor knows how to store material and things like this don't happen.

I don't follow why the exterior "door" area wasn't dried in to begin with - rather than start work on the inside.

Contractor. Not your problem if he is honest. Big hassle if he stiffs you and you have to "get legal on his azz." (apologies to Pulp Fiction)

Why worry?

He'll replace his own mortar and do the job.
Until then, think about something else.

Mortar is cheap.
