Ex wife totalled FJ Cruiser, I'm still on title

Yep, she finally did it. Rolled it. Totalled the 2007 JF Cruiser we bought. I put about $10,000 into modding it for off-roading... snorkel, steel bumper, lift kits, skid plates... Had quite a bit of money invested into it, aside from the money I actually paid into it. So it's totaled. Insurance paid out about $13,300. Check in both our names. I'm not there to sign. I'd like a bit of return on it, personally. Advice?

Have her sign it and mail it to you. You can sign it, deposit it, and send her half.

I can guarantee you she won't go for that though.

If your name is/was on the check she couldn't possibly cash or deposit it without your signature. If she signed your name, she committed fraud...both the bank, and more importantly the insurance company will want a chat with her. The title is key. If the divorce settlement gave her the car and this is an admin hangover, then everything changes. Which is it?

Ex as in paperwork is all done and filed with the courts? Property was divided? If so, her truck and your name on the title is a oversight. Sometimes it's not a good idea to poke the bear. Have her mail you the cheque, sign it and mail it back if you live in different cities. Once the love is gone the only thing left is the money and everyone always feels they have gotten the bad end of the stick over that.

Contact the insurance company before the check is negotiated and see if they'll split it into 2 different/separate checks. I have seen this done before. What could it hurt? Was the car free and clear?

She'll need to buy another car and 13k won't buy her much. Unless she slept with your brother and shot your dog... | ||

Car is free and clear We didn't fight over who was taking what, so there really wasn't anything in the divorce settlement, as I recall. It was a pretty "clean" divorce. As far as divorces go. She bought the wreck back, and is removing all the mods to it.

Just be glad she did not hurt some other driver or passenger. You could have been on the hook for the damage.

depends how it went, amicable etc. If its ok then shouldn't be a prob to get something back, but suspect that isn't the case. As mentioned do the decent thing, let her keep it AND tell her to get driving lessons with the rest ;-)

It is highly unlikely for a vehicle to be left off of a property settlement agreement and you would have had to sign one to finalize your divorce. Unless for some reason the vehicle was left off the property settlement agreement, you won't have a choice to make here.

Tell her you'll sign it but you want your name off the title first.

Primarily,.she was the driver. We were both on the loan. I paid a large amount of money toward the down payment, and then sunk $10,000 into modding the hell out of it. She then made the payments. She's not getting it fixed. She bought it back to strip off (and presumably sell) the modifications, since the mods were wroth almost what they paid out for it. I expect she'll part out the rest of it. She got the wreck back for very little. She'll come out way ahead. Guess I'll let her keep it.

$10k to mod a Toyota? That's money out the window in the best of circumstances. Heck, the lift kit may have been partially the cause of the rollover. Be glad you're not getting sued. Give her the money and put it/her behind you.
