of course he told her to choose, he also told her to just sign the ticket and then she could mail the fine. look at the video again. you won't have to go past 1.41. I understood what he said, it must have been pretty clear.

I saw where he said "you don't have to sign the citation" and her third option was to see a judge now.

That's after he told her she had to choose now. She said "according to who" to which he replied "according to the the state on New Mexico" after which he said "if you don't want to sign....."

He could have simply corrected himself and she would have signed. But she was under the impression she HAD TO MAKE A CHOICE RIGHT NOW. Her initial argument was that she didn't know what she was going to do (pay or show). She never said she wouldn't sign. That was the cop's suggestion. Everything went wrong before 1:30

Bad cop. Simple.

Regardless of what she understood or misunderstood, or whether the policeman could have been clearer, he was being reasonable. What she did, in refusing his - I assume lawful- directions, and then taking off was just plain stupid. Im sure the argument will be panic, but she could easily have caused a situation which got her her teenager shot dead. And it went downhill from there- the potential for disaster by everything that happened subsequently...

I feel like you and I are stuck in the first 1:40 of the video.

She DOES NOT HAVE TO CHOOSE, but she DOES HAVE TO SIGN.

Choosing is not signing. Signing is not choosing.

The initial disagreement was whether or not she had to CHOOSE and the cop keep pressing her to CHOOSE.

(Sorry for the caps...can't easily bold on iPhone)

And I and not condoning her behavior.

I suspect a good lawyer will focus on the first 1:30 of the video, and the cop will admit he was wrong to try and make her choose.

I've been in heated debate with my teenagers during which they fail to realize what they said, but rather strongly believe they said something else. Any attempts to correct or remind them of their actual statement is just like beating my head against the wall.


This is poor communication at its best.

I think some of you were watching a different video. Cop #1 showed remarkable restraint and patience against a woman who thought the law didn't apply to her. He didn't shoot the teen that probably should have been shot when he went for the cop's gun. Tell me again how this is an easy job?

You all who are saying the cop didn't explain her options.....he said she had to pick one right then - isn't that the law in that state?

That woman was an idiot. Good thing she isn't breeding.

Considering her kid assaulted a cop, obviously the apple doesn't fall far from the tree.

Signing the citation is NOT an admission of guilt, it is simply a promise to comply (release on Own Reconnaissance) (OR) with one of the following options:
Pay the fine, elect to attend a traffic school or request a court date.
If you choose not to sign then you have to post a bond which is the amount of the citation. The bond can be posted on scene or at the jail. The easiest way to go is to be OR released by signing to comply with one of the options.
That being said, the officer who shot at the vehicle was wrong and should have been terminated from his job,it was completely uncalled for and I'm sure against the department's ues of Deadly Force policy. The rest of it was a goat #$%^, and I'm just happy that no one was injured.
When someone didn't sign during my career, we would call a supervisor to the scene to try to give the motorist a second chance to be persuaded to take the OR option. It worked most of the time.
It's easy to Monday morning QB these situations, but in real time decisions are made pretty quick, then they are subject to being picked apart by people with the luxury of taking months to look it over and discuss it with others, and in this case, review the video.
This will become a good training video that will help cops learn what they can and should do as well as what they shouldn't do.

which can be hard on action Harry's and wanna be Stallone's...
after all..
